What should I expect of a Settlement Agent?

When you are aiming to purchase a piece of land, or a home, or business premises it is actually at this stage you should consider who to select as your property settlement agent or conveyancer.  An experienced and knowledgeable conveyancer can provide a buyer or seller with unbiased contract advice.
 
You may already know of an excellent settlement agent or conveyancer who has been recommended to you by a family member or friend.

These are some of the most important things to consider when selecting a settlement agent.

It is a good idea to ask the conveyancer how many years experience they have had as a property conveyancer.

Conveyancing is a complicated and time consuming process and for the inexperienced and/or the uninformed it can present a minefield of traps.

In order for a settlement agency to operate legitimately as a business in the State of Western Australia they must hold a ‘current triennial certificate’ which is granted by the Settlement Agents Supervisory Board.

Anyone who buys property, whether privately or as a business, can have confidence in a settlement agent licensed by the Settlement Agents Supervisory Board. A licensed settlement agent must have appropriate qualifications, experience, adequate materials and financial resources – and be of good character and reputation.

The role of a property conveyancer or settlement agent

Conveyancing is the legal process of transferring the registered ownership of a property from one owner to another.  Essentially, it is a time consuming and complicated legal process that can take between 6 to 8 weeks.  A settlement agent cannot and should not give you legal advice, nor act for both the buyer and the seller……unless of course both parties agree in writing (i.e. on the ‘appointment’ form.)

The fundamental job of the property conveyancer is to make sure that the property title ownership is transferred successfully to the new owner.

When you choose a knowledgeable and experienced property conveyancing/settlement agent the settlement should proceed without any problem.  A quality settlement agent will be able to:

  1. Ensure trouble free lodgement and transition of paperwork, and as a result of their expertise and experience, they can often speed up the process.
